   An act to amend Section 68078 of the Education Code, relating to
public postsecondary education, and declaring the urgency thereof, to
take effect immediately.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 632, Romero.   Public postsecondary education:  student
residency requirements.
   Existing law establishes the segments of public postsecondary
education in the state, including the University of California, the
California State University, and the California Community Colleges.
Existing law prescribes requirements for the classification of the
residency of the students at public institutions of postsecondary
education, and generally requires that students who are classified as
nonresidents of the state pay nonresident tuition.
   This bill would require that, notwithstanding any other provision
of law, a student holding an emergency permit authorizing service in
the public schools of the state, who is employed by a school district
in a full-time position requiring certification qualifications for
the academic year in which the student enrolls at an institution in
courses necessary to fulfill teacher credential requirements, is
entitled to resident classification only for the purpose of
determining the amount of tuition and fees for no more than one year,
as prescribed.
   The bill would declare that it is to take effect immediately as an
urgency statute.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:


  SECTION 1.  Section 68078 of the Education Code is amended to read:

   68078.  (a) A student holding a valid credential authorizing
service in the public schools of this state who is employed by a
school district in a full-time position requiring certification
qualifications for the college year in which the student enrolls in
an institution  is entitled to resident classification if  that
student meets any of the following requirements:
   (1) He or she holds a provisional credential and  is enrolled at
an institution in courses necessary to obtain another type of
credential authorizing service in the public schools.
   (2) He or she holds a credential issued pursuant to Section 44250
and is enrolled at an institution in courses necessary to fulfill
credential requirements.
   (3) He or she is enrolled at an institution in courses necessary
to fulfill the requirements for a fifth year of education prescribed
by subdivision (b) of Section 44259.
   (b) Notwithstanding any other provision of law, a student holding
a valid emergency permit authorizing service in the public schools of
this state, who is employed by a school district in a full-time
position requiring certification qualifications for the academic year
in which the student enrolls at an institution in courses necessary
to fulfill teacher credential requirements, is entitled to resident
classification only for the purpose of determining the amount of
tuition and fees for no more than one year.  Thereafter, the student
shall be subject to Article 5 (commencing with Section 68060).
   (c) This section shall not be construed to affect the admissions
policies of any teacher preparation program.
  SEC. 2.  This act is an urgency statute necessary for the immediate
preservation of the public peace, health, or safety within the
meaning of Article IV of the Constitution and shall go into immediate
effect.  The facts constituting the necessity are:
   In order to address the serious shortage of credentialed teachers
in this state as soon as possible, it is necessary that this act take
effect immediately.
